حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا وَكِيعٌ، عَنْ زَكَرِيَّا، عَنِ الشَّعْبِيِّ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنَّهُ بَاعَ مِنَ النَّبِيِّ صلى الله عليه وسلم بَعِيرًا وَاشْتَرَطَ ظَهْرَهُ إِلَى أَهْلِهِ . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنْ جَابِرٍ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ . يَرَوْنَ الشَّرْطَ فِي الْبَيْعِ جَائِزًا إِذَا كَانَ شَرْطًا وَاحِدًا . وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ لاَ يَجُوزُ الشَّرْطُ فِي الْبَيْعِ وَلاَ يَتِمُّ الْبَيْعُ إِذَا كَانَ فِيهِ شَرْطٌ .
Câbir b. Abdullah (r.a.)’den rivâyete göre: “Kendisi, Rasûlullah (s.a.v.)’e bir deve sattı ve evine gidinceye kadar deveye binmeyi şart koştu.”
Narrated Jabir bin ‘Abdullah : That he sold a camel to the Prophet (ﷺ) and made a condition that he could ride it to (return to) his family. [Abu 'Eisa said:] This Hadith is Hasan Sahih. It has been reported through other routes from Jabir. This is acted upon according to some of the people of knowledge among the Companions of the Prophet (ﷺ) and others. They consider it allowed to make a condition in a sale when it is one condition. This is the view of Ahmad and Ishaq. Some of the people of knowledge said that it is not allowed to make a condition in a sale, nor to complete a sale when there is a condition for it

Rasûlullah (s.a.v.)’in ashabından ve diğerlerinden bazı ilim adamlarının uygulaması bu hadise göre olup alış veriştie şart koşmayı tek bir şart olursa caiz kabul ederler. Ahmed ve İshâk bunlardandır. Bazı ilim adamları ise alışverişte şartı kabul etmezler, şart olduğunda alışveriş tamamlanmış olmaz derler
